摘要: | 由於台灣地區大量人口集中於都市,使都市化提升及經濟結構改變,造成各種產業對土地的需求增加,政府為配合國內經濟結構轉型與各類產業用地需求改變,各相關部門乃釋出大量農地供住宅、商業、工業、及工商業綜合用地等使用。
台灣目前所實施的土地使用規劃及管制制度,依據現行計畫體系,將國土劃分為都市土地及非都市土地兩種規劃方式,分別由都市計畫法和區域計畫法制定,進行土地使用規劃及管制。其土地使用之變更,藉由通盤檢討或個案兩種方式進行土地變更;然而,兩套土地使用管制機制與審議程序卻有所不同。
使得土地使用變更回饋制度至今有20多種方式,卻未有彈性的審議規範,在各處之解釋名詞和定義又有所差異,使回饋比例標準、項目與理念凌亂毫無可遵循之法令,因此產生相互間競合問題。
基於此,將以都市土地與非都市土地兩種土地使用計畫,探討變更回饋制度在都市土地與非都市土地的差異性及檢討這兩者間內容的優缺點,並提出建議之策略。

The currently implemented by land-use planning and control institution are based on current project system in Taiwan, splitting the land into two kinds of planning methods which are urban lands and non-urban lands, enacted by Urban Planning Law and Regional Planning Law, conducting land use planning and control. The changing of the land use is by an overall review or case analysis; however, two sets of land use control mechanisms and review process is different.
So far, there are 20 ways can make the land use change feedback system, but there is no consideration of a complete specification, such as the Council for Economic Planning develop the comprehensive land development plan known as the "association fee", the Agricultural Development Act referred to as " feedback fee", Regional Planning Act referred to as the "development impact fee", so that the standard of feedback ratio, items and ideas became messy and no ideas to follow, resulting in the problem of competing with each other.
Based on this, making the two land using plans of urban lands and non-urban lands, investigating the changing on feedback system change in urban land and non-urban land, and analyzing the advantages and disadvantages, and bring forward the strategy. |
