「法定訴願承受」者,自然人或法人於提起訴願後死亡或因合併而消滅時,該訴願程序由得承受訴願之人承受,續行訴願程序之制度。訴願實務上,關於法定訴願承受之問題頗多。本文以此爲題,除探討學說上之相關見解外,並整理分析訴願及行政訴訟實務上相關之決定與裁判,結合理論與實務,提出相關問題之解決方法。文末並試擬未來訴願法修正時之建議方案,以供參考。此外,以死亡之人名義提起訴願,其固非法定訴願承受之問題。惟其與自然人於訴願程序中死亡之法定訴願承受有頗多共通之處,實務上亦滋生諸多困擾。本文一併探討之。
