    Abstract: 隨著經濟發展與社會變遷,產業結構逐漸發生變化,同時勞工工作意識也不斷轉變,促使勞務型態與雇用型能趨向多樣化,派遣勞動可以說是在此種社會經濟背景與勞資雙方需求下之產物。   若從保障勞工生存權之目的著眼,再參酌憲法規定精神及營動基準法之立法理念,則有關派遣勞動之勞動關係,大約蘊含有下列各點問題: 第一、勞工派遣公司是否有中間剝削抽取不法利益之情事。 第二、是否會因為派遣勞動之大量實施而產生雇用不安定之結果。 第三、第三、派遣勞工與一般正規勞工間是否會產生差別待遇狀況。 第四、派遣勞動是否會造成雇主責任不明確。 為解決上述各問題,首先必須釐清派遣勞動與一般其他傳統勞動之差異。依派遣勞動僱用實態,大約可分為「常用僱用型派遣勞工」與「登錄型派遣勞工」兩種。派遣是派遣公司之雇主,與勞工訂立勞動契約,於得到勞工同意,維持勞動契約關係之前提下,使其在要派公司事業主指揮監督下為勞務給付,該勞工與要派公司事業主間並無勞動契約關係存在。因此派遣之特徵在於□派遣公司與派遣勞工間存有勞動契約關係,□派遣勞工與要派公司間,僅有派遣勞工於有派公司指揮命令下才服勞務之關係,□派遣公司與要派公司間不得有派遣公司仲介勞工,而由要派公司雇用之約定。
    Refer to the economic development and the change of social, and the variation of industrial structure, moreover, labors change their work consciousness unceasingly, the types labor service and employment are inclined to diversify. The condition of the background of social economy and the demand of the labor and capital come into the dispatch labor. From the purpose of assuring subsistence right for labors, and to deliberate about the essences of the stipulation of the Constitution and the concept of legislation of the Standard Labor Law, in relation to employment relationship of dispatch labor there are some issues included: 1.Are the labors exploited from the employers of the dispatch companies who draw out the illegal benefit? 2.Does it come into being the unstable consideration of employment, refer to carry out the dispatch greatly? 3.Is it the different treatment between the dispatched labors and the general labors? 4.Does the dispatch labor make the indefinite responsibility of the employers? So as to resolve above-mentioned questions, it should begin by making out the difference between the dispatch labor and the general traditional labor. Depend on the real situation of employment of the dispatch labor there are two types, one is the dispatched labor in common employment, the other is the dispatch labor in register employment. The definition of is the employer of the dispatch company makes the labor contract with the labors, and the labors do labor service at the command and supervision of the demand dispatch company makes the labor contract with the labors, and the labors do labor service at the command and supervision of the demand dispatch company by the agreement of the labors and existence of the relationship of labor contract. But the relationship of labor contract doesn't exist between the labors and the demand dispatch company. The characteristics of dispatch are: (1) To exist the relationship of labor contract between the dispatch company and the dispatched labors. (2) To do the labor service at the command and supervision of the demand dispatch company. (3) Not to lead in the labors by the dispatch company to the demand dispatch company, but the demand dispatch company arranges to employ.
