不少人對一黨同時掌控行政與立法表示憂心,認爲權力的壟斷將對台灣民主發展不利,但此一觀點的邏輯性及可信性值得檢視。制衡乃建立於衝突的概念上,而要避免衝突割裂社會,便必須國人具有包容的胸襟,國人對此似乎仍有不足。且台灣兩大黨乃以國家認同形成競爭關係,這類訴求缺乏妥協性,衝突易於形成社會的分裂,不利制衡。美國制衡的成功,乃因存在社會多元主義,使衝突不致脫序,台灣則無此條件。故現行台灣民主仍以行政立法同屬一黨掌控較佳,權力制衡可透過其他設計達成,如媒體自由與人民團體自主。台灣立院權力有限,且又難以匯集集體意志,主要功能既爲監督行政,兩權制衡並無實際之急迫性,故現實考量應以追求政治穩定爲要務。
After the Presidential election, many worry about the effects of one party controlling both the executive and the legislative power. However, logical analysis and empirical studies show that the concern is unfounded. As an emerging democracy, Taiwan is still learning to tolerate people with different opinions. As such, the confrontation between one party controlling the executive power and the other with the legislative power could be detrimental to political stability. The success of American example can be attributed to its social pluralism, which is not discerned in the Taiwanese society. Check and balance between two powers is simply one device to prevent the abuse of power, yet, its realization depends on many complicated and cultural factors. To a new democracy, political stability should be the most important concern. In addition, with the legislative power much weaker than the executive power in Taiwan, the check of the executive power on the legislative power is not compelling. Political stability should be a concern prior to power abuse.
