歐洲自1950年代興起歐洲整合運動,從經濟整合邁向政治整合之路,逐漸成立具有超國家性質之歐盟組織,是為重大成果。歐洲政治菁英參考美國立憲成功經驗,發起具有制憲會議性質之政治活動,其後制定《歐洲憲法條約》,試圖將歐盟推向更高遠之整合目標。然成員國與歐洲民意,對此政治發展大幅變化,出現抵制與不信任,致使歐盟憲政前景及整合運動遭逢挫敗。
在政治危機之下,歐洲接連出現債務風波、歐洲難民潮與英國脫離歐盟,多重挑戰混和而至,衝擊歐洲穩定及整合發展。過往依賴政治領袖菁英協商模式,因利益分歧而難以發揮功效,既有政策或治理方式無法全然克服危機,凸顯歐洲整合過程,欠缺健全制度設計,當前更陷入憲政路線不明的問題。
本文探討歐洲整合下的憲政發展,何以因遭逢危機而顯現既有體制之不足,甚至衝擊歐洲社會認同問題。另從美國聯邦憲法的立憲成功經驗,對比歐盟制憲及政治整合陷入停滯,針對關鍵因素與背景分析,亦為探討重點。至於二十一世紀以來歐洲政治轉變劇烈,政府間主義曾為研究與實務上運作的主軸,何以出現鬆動,其與危機事件的關聯性,必須予以檢視。歐洲近年所經歷多項危機,透過若干轉折及制度改變,是否已經擺脫陰霾,以及不等速歐洲的現實條件下,憲政困局能否重新起步,期待曙光,是為歐洲研究的新課題。
Since the 1950s, the route of the European integration movement had a major change from economics to politics level which made remarkable outcomes. The born of the European Union is a political achievement by the European community to build a supranational regime. The European powerful leaders and political elites raised political events with the Constitution Convention like, referring to the experience of the United States of America, made the “Treaty Establishing a Constitution for Europe” which were following the spirit of federalism and constitutionalism. Despite the decision having been made, European voters disagreed with those transforms, then the obstacle of the European integration movement and constitutional dispute occurred.
The crisis of the national debts, refugee problem, and Brexit has compounded and impacted the European communities hardly in the 21st century. Due to the European Union system failing to respond to those issues immediately, the problems of close-door negotiation and lack of transparency decision-making by European elites and politicians make the European constitutional development unclear.
In this thesis, finding the reason for the crisis in Europe and exploring how the problems have been resolved is the major work to complete. To compare the Constitution of the United States of America to the situation in Europe, this research would like to figure some elements that could be enumerated. Finally, the approaches of the Europe studies have some new trends which go by the European crisis and future integration, as well as be another core analysis in the thesis
