| 摘要: | 我國自1996年公布營業秘密法，已經25個年頭。其中歷經數次修法，其中最重要的一次莫過於2013年增列的刑罰化條文。自2013年自2017年，檢調單位偵辦57件營業秘密案件，有27件起訴，僅2件判決確定，究竟是我國法令不夠完備還是整合機制出現問題?本文以營業秘密與國家安全的關聯性進行探討，包含最重要的美國經濟間諜法，對照我國的營業秘密相關法規並做出建議。
2018年有一營業祕密被竊新聞，中國科技間諜一杯咖啡偷走了75億可用於軍事上砷化鎵技術，此項科技可運用於雷達、衛星、飛彈及各種航太設備。此項研發技術若被竊影響層面將擴及美中兩國軍事競賽，也可能影響亞太地區的區域安全包含我們自身的國家安全。2019年另一則新聞指出蘋果前華裔中國工程師不只偷自駕車技術，還偷愛國者飛彈機密檔案。因此連我們國家的最後一道保護防線機密也被對岸間諜竊取，真是影響重大。
2018年開始諸多因素掀起美中貿易戰，其中一項重要的因素就是美方對中方歷年來侵害美方智慧財產權的報復，這也更提醒了我們要更加重視營業秘密的管理與維護，雖然我們曾經有國家智財戰略綱領，而美國及韓國的各項作為同時也值得我們學習與參考。
It has been 25 years since my country publicized the Trade Secrets Law in 1996.The law has been amended several times, and the most important one is the penalization provision added in 2013. Since 2013 to 2017, the prosecution unit has investigated and handled 57 trade secret cases, with 27 prosecutions, and only 2 judgments have been determined. Is it because my country’s laws and regulations are not complete or there are problems with the integration mechanism? This article discusses the relevance of trade secrets to national security , including the most important US economic espionage act, and make recommendations in comparison with my country’s trade secret laws and regulations.
In 2018, there was news about the theft of a business secret. A Chinese tech spy stole 7.5 billion gallium arsenide technology at a cost of a cup of coffee that could be used in the military. This technology can be used in radar, satellites, missiles and various aerospace equipment. If this research and development technology is stolen, the impact will extend to the military competition between the United States and Mainland China, and it may also affect the regional security of the Asia-Pacific region, including our own national security. Another news item in 2019 pointed out that the former Chinese engineer of Apple not only stole self-driving technology, but also stolen the confidential files of Patriot Missile. Therefore, even the secrets of our country's last line of defense have been stolen by spies on the straits, which is really significant.
Since 2018, many factors have set off the US-China trade war. One of the important factors is the US's retaliation against China's infringements on US intellectual property rights over the years. This also reminds us to pay more attention to the management and maintenance of business secrets, although we ever have the national intellectual property strategy program policy,the various actions of the United States and South Korea are also worthy of our study and reference. |
