本文旨在分析巴勒斯坦在聯合國之法律地位。全文共分六章,第一章是緒論,說明本文的研究動機、研究目的、研究方法與範圍。第二章則從法律觀點探討巴勒斯坦問題的演變,在本章中除將釐清巴勒斯坦問題的始末,並能藉此對巴勒斯坦的法律地位有更符合國際法觀點的認識。第三章著重巴勒斯坦在聯合國大會的法律地位,有關其在大會的觀察員實體、非會員觀察國所代表的法律意義將在本章進行探討,並解釋聯合國關於巴勒斯坦法律地位的重要決議所產生之影響。第四章則述及巴勒斯坦在聯合國其他組織之法律地位,分析國際法院對於巴勒斯坦土地的諮詢意見及巴勒斯坦在聯合國教育、科學及文化組織會員國地位的法律意義。第五章介紹巴勒斯坦二○一一年申請入聯案的法律爭議,從國際法觀點提出巴勒斯坦入聯案所產生的法律困境,並解讀入聯案後續的可能發展。最後,本文將就巴勒斯坦在聯合國之法律地位作一綜合性評析,除提出本文的研究發現,並嘗試預測未來巴勒斯坦國家地位的可能進展。
Middle East has been an area of hostilities. The Israeli-Palestinian conflict can be regarded as an imminent explosive powder keg in the world. The question of Palestine is an international knot hard to be loosened as clashes between the two parties involve wars, terrorist attacks and diplomatic negotiations. In the study of the Israeli-Palestinian conflict, the legal status of Palestine has been a controversial issue. Some consider the Palestinian statehood favorably while some do not. The United Nations has thus become an important field in which the two camps wrestle.
It is very worthy of examining the legal status of Palestine in the United Nations since UN is the most influential international organization. On November 29, 1947 the General Assembly adopted resolution 181, advocating the establishment of an Arab state and a Jewish state in Palestine and Jerusalem was referred to as the international condominium. However, the resolution has not been implemented for the Arab countries rejected it. Thereafter, with a number of historical factors, the legal status of Palestine has become more and more complicated.
This article covers, inter alia, recognition of state in international law. When studying recognition of state, we tend to focus on the controversy of constitutive theory and declaratory theory instead of assessing the practice in international organizations, especially in the United Nations. An analysis of the legal status of Palestine in the United Nations may also enable us to perceive the concept of recognition of state more thoroughly.
