    Abstract: 我國消費者債務清理條例之制定,起因於2006年所爆發之卡債風暴,由於金融業者長期以來對信用卡與現金卡的濫行發卡,造成消費者依賴使用塑膠貨幣支付日常生活開銷,而未衡量其自身經濟能力,使得刷卡金額超過其所能負擔之範圍而無法繳納,而銀行向其收取高額利息與違約金,形成債務人無法承擔的巨額負債,且因債務人不堪銀行與資產管理公司的長期騷擾,最終走上絕路,造成無法挽回之社會問題。
    政府為解決此問題,遂委由專家和學者以研修中之破產法修正草案所定消費者債務清理相關規定為基礎研擬出現行的消債者債務清理條例,並希冀藉由此條例中關於更生及清算制度的雙軌制運作下,能有效幫助陷於多重債務之債務人獲得經濟重生。
    Regulation on Consumer Debt Clearing Act originates from credit card debt crisis in 2006. For many years, financial institutions have been issuing credit cards under relaxed standards. Consequently, consumers overly rely on credit cards to pay bills without taking into account ability to repay, cause late payments. Along with coping with high interests and penalties charged by financial institutions, consumers are not able to withstand, leading to a variety of social issues.

    To resolve, the government teams up with academics and experts and devise the current regulation based on the current bankruptcy draft. The government hopes such regulation on discharge and liquidation would effectively alleviate stress and provide financial assistance to consumers in great debt.
