    Abstract: 都市快速發展到一定程度時,便會衍生出都市老化的問題。為了解決都市老化,都市更新是都市再生較佳的選擇之一。都市更新的目的是促進都市土地有計畫之再開發利用,以期復甦都市機能、改善居住環境、並增進公共利益。為了都市更新的推行,常會使用獎勵容積的方式增加建築容積,來提高都市更新案的申請意願;而案中實施更新團體則提供公共設施供大眾使用,是獎勵容積最常見方式。藉由此種獎勵方式所產生空間,其龐大利益分配,卻未必能在法律的規範,從而產生不公的現象。空間議題是地理學長久以來所關注的,並自1960年代晚期,地理學開始重視社會正義的議題,並促使激進地理學的發展。社會正義在探討社會利益與負擔的分配及其產生之原因,以期能公正地分配。本研究以台北市近年來所推行之都市更新案為研究題材,針對其公益設施成本與獎勵容積利益之分配進行分析與比較。研究發現在都市法規修正前後,以捐贈公益設施獲得獎勵容積之更新案減少,其主要原因為獎勵容積之減少所導致誘因降低,此外,因都市更新所產生獎勵容積之空間利益,得利的都市更新私部門為少數,為利益分配之不公,有違社會正義。
    When the city develops to a certain extent, the city will have some problem of aging. In order to solve this problem, the governments carry out "urban renewal" policies to cope with it. Urban renewal makes the urban land to reuse with the urban planning, the urban function to recovery, the life to improve, and to raise the public Interest. To carry out the urban renewal effectively, the governments usually offer the floor area incentive to raise the case for the efficiency of urban renewal. The implementations of urban renewal groups usually offer the public area facilities to change the floor area incentive. There are so many interests with the space of incentive. But the distribution of benefits is unfair. Since the late 1960s, geographers paid close attention to the topics of social justice. It brings the development of Radical Geography. Social justice is a normative concept concerning the ways in which resources and benefits should be shared across society. In this study, the researchers use the case of urban renewal in Taipei city as a case study, and discuss the distribution of the cost of public area facilities and the floor area bonus. It found that there are three participants. They are the governments, the implementations of urban renewal groups, and the house owner of urban renewal case. According to law, the distribution of interests and the pass of cost should be fair but not. There are unfair Principles to distribute. It do not conform to social justice.
